The provisions regarding notarial fees in France were amended by the French law No. 2015-990 of 6 August 2015 regarding growth, business and the equal economic opportunities.
A Decree and an order of 26 February 2016 set the new tariffs for notaries pursuant to the aims of the law of 6 August 2015, known as the Macron Law (Decree No. 2016-230 of 26 February 2016 and the order of 26 February published in the Official Journal on 28 February 2016).
Pursuant to article L. 444-2 paragraph 5 of the French Commercial Code (Code de Commerce), notaries may grant a discount in the event that a tariff is determined in proportion to the value of a right or a property.
This option is however governed by article R. 444-10 of the French Commercial Code.
Pursuant to this regulation, the amounts of discounts on fees granted by Prud’homme & Baum are as follows:
Instruments relating to financing
a) Loans, obligation with or without a guarantee regarding property for residential use – Article A 444-143 of the French Commercial Code (number 137 Table 5 appended to article R 444-3 of the French Commercial Code)
