Divorce proceedings: Prud’homme & Baum guides you

A notary is now the first person to become involved when a couple agrees to divorce. Since 1 January 2005, there are now four types of divorce proceedings in France:

  • 1st proceedings: divorce by mutual consent;
  • 2nd proceedings: divorce on the basis that both spouses accept that the marriage has broken down;
  • 3rd proceedings: divorce following irrevocable damage to the conjugal bond;
  • 4th proceedings: divorce for breach.

he 2nd, 3rd and 4th proceedings before the judge all begin with an attempt at reconciliation. Depending on whether you are common law spouses (concubins), in a civil partnership (pacsé) or married, different legal forms of sharing can be chosen from: licitation or rachat de part – in which one spouse buys out the other – or liquidation of the marital assets or the indivisum, regardless of the type of divorce.
